Supreme Court Says Consensual Pre-Marital Relationships Between Adults Not a Crime, Emphasizes Personal Liberty

In a significant observation regarding pre-marital relationships, the Supreme Court of India addressed prevailing social misconceptions and stated that imposing restrictions or pressure in such matters is not appropriate.

The Court made it clear that consenting adults have the right to make decisions about their personal lives, and society must understand that personal liberty, within the bounds of law, deserves protection. During the hearing, the Court emphasized that pre-marital relationships should not be viewed merely from a social perspective but also in the context of legal rights and individual freedom.

According to the Court, pressuring an adult regarding their private life points toward a violation of constitutional rights. It further observed that consensual relationships between adults cannot be treated as criminal acts.
